Portaria MTE Nº 104 DE 29/01/2026
Altera a Norma Regulamentadora Nº 28 (NR-28) - Fiscalização e Penalidades.
O MINISTRO DE ESTADO DO TRABALHO E EMPREGO, no uso das atribuições que lhe conferem os art. 155 e 200 do Decreto-Lei nº 5.452, de 1º de maio de 1943 - Consolidação das Leis do Trabalho - CLT, e tendo em vista o disposto no inciso VI do art. 1º, Anexo I, do Decreto nº 12.764, de 28 de novembro de 2025, e no Processo nº 19966.200136/2023-32,
Resolve:
Art. 1º - A Norma Regulamentadora nº 28 (NR-28) - Fiscalização e Penalidades, com redação dada pela Portaria DNSST nº 3, de 1º de julho de 1992, passa a vigorar com as seguintes alterações:
"28.1.1 A fiscalização do cumprimento das disposições legais e/ou regulamentares sobre segurança e saúde do trabalhador será efetuada obedecendo ao disposto no Decreto nº 4.552, de 27 de dezembro de 2002, no Título VII da Consolidação das Leis do Trabalho - CLT e na Lei nº 5.889, de 8 de junho de 1973, sem prejuízo da aplicação de outras disposições pertinentes ao tema." (NR)
28.1.3 O agente da inspeção do trabalho deverá lavrar o respectivo auto de infração à vista de descumprimento dos preceitos legais e/ou regulamentares contidos nas Normas Regulamentadoras considerando o critério da dupla visita, elencado no Decreto nº 4.552, de 2002, no Título VII da CLT e no § 3º do art. 6º da Lei nº 7.855, de 24 de outubro de 1989." "28.3.2 Nas atividades rurais, assim entendidas aquelas relacionadas à agricultura, pecuária, silvicultura, exploração florestal e aquicultura, bem como naquelas atividades previstas nos itens 31.2.2 e 31.2.2.1 da Norma Regulamentadora nº 31 (NR-31), as infrações aos preceitos de segurança e saúde do trabalhador, previstas no quadro de infrações (Anexo II) desta Norma, serão sancionadas conforme o critério de cálculo disposto no art. 18, caput, da Lei nº 5.889, de 1973, em relação aos autos de infração lavrados a partir da vigência desta Norma." "28.3.3 Os valores de multas previstos nesta NR devem ser reajustados anualmente na forma do art. 634, § 2º, da CLT, com redação da Lei nº 13.467, de 13 de julho de 2017, e conforme regulamentação da portaria que estipula os parâmetros para a aplicação das multas administrativas previstas na legislação trabalhista." Art. 2ºO Anexo II da Norma Regulamentadora nº 28 (NR-28) - Fiscalização e Penalidades, com redação dada pela Portaria SEPRT nº 1.067, de 23 de setembro de 2019, passa a vigorar com as seguintes alterações:
